Ferry Service Voice Message Alert System Terms and Conditions Provided by the City of Alameda ("City")
Terms of Service - Participation in the City Ferry Service Voice Message Alert System ("VMAS") is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your registration with the City of Alameda VMAS constitutes your agreement to all such terms, conditions, and notices.
PLEASE READ THE FOLLOWING TERMS OF USE AND DISCLAIMERS CAREFULLY BEFORE REGISTERING FOR THE VMAS. By registering for the VMAS, you acknowledge that you understand and agree to these terms of use, conditions and all applicable laws. If you do not agree to these terms, please do not register for the VMAS.
Notice: The Ferry Service Voice Message Alert System ("VMAS") is provided by the City as a customer benefit designed to provide ferry commuters with real time notification of actual service disruptions. To offer this benefit, the City has contracted with Call-Em-All, Inc., a company that provides for voice message distribution and maintenance of the subscriber phone number list. While the City, its ferry operators (Blue and Gold Fleet, and Harbor Bay Maritime), and Call-Em-All, Inc., will make every effort to provide timely and accurate voice notification of significant service disruptions, neither the City, its ferry operators or Call–Em-All are responsible for any damages resulting from failure of a registered VMAS participant to receive a VMAS message, to receive a message in a timely manner, or for any errors and/or omissions in the VMAS message. Cell phone and voicemail communications are not 100% reliable and neither the City, its ferry operators, or Call-Em-All, Inc., assume any responsibility for undelivered call notifications due to typographical, technical, server or any other reason.
Delivery of VMAS messages is made on a "best effort" basis. All such content is regarded as informational and not as life saving in nature. Deliveries of such messages might be subject to delay or failure
1. Limitations on Use. By registering for the VMAS you represent that you are at least 18 years of age and that your are authorized to use the phone number(s) you have registered for the VMAS service for the receiving of VMAS messages. You also acknowledge that VMAS messages may be delivered to the phone number(s) you have registered with VMAS between 5:00 AM and 10:00 PM, Monday through Friday.
2. Disclaimer of Warranty and Limitation of Liability. The City, Blue and Gold Fleet, Harbor Bay Maritime and Call-Em-All, Inc., will not be liable for any lost profits, loss of business, loss of savings or other consequential, incidental, indirect, exemplary or punitive damages resulting from the failure to send or receive a VMAS message or for any errors and/or omissions in a VMAS message. The City, Blue and Gold Fleet, Harbor Bay Maritime and Call-Em-All, Inc., make no representation or any warranty that VMAS messages will be accurate, complete, reliable, current or error-free.
3. Privacy Policy – Unless required by law, the City will not share, sell or divulge any information that you share with us to anyone.
